Polish driving license valid in Germany

In connection with the acquisition of a driving license in Poland (or its validity in Germany), the Prenzlau District Court decided on September 24, 2013 in favor of the accused driver with a Polish EU license after an exciting criminal case involving the lawsuit “Driving without a driving license” (§ 21 StVG). -Driver’s license:

The German client had already lost his German driving license years earlier because of driving a vehicle while under the influence of alcohol. However, the car driver did not complete an MPU. Instead, the man helped himself to get a new driving license with the solution: after the set blocking period had expired, simply  buy a new EU driving license in Poland . He got his driving license again, this time at a driving school in Poland, where – in accordance with the 185-day rule – he was also able to prove that he had a place of residence at the time it was issued.

With rulings in similar cases, the European Court of Justice has confirmed several times in recent years that the driving license must be recognized (see ECJ rulings C-329/10 of June 26, 2008 or C-184/10 of May 19, 2011). The EU member states have a fundamental obligation to recognize each other’s driving licenses as valid. An exception to this recognition obligation can only be claimed if there is a residency violation. Such a violation occurs, for example, if it is apparent from the driving license itself (i.e. if, for example, Berlin was entered as the place of residence on the Polish driving license), or if the violation results from other, indisputable information coming from the issuing Member State. The proceedings were discontinued and the client was allowed to continue driving with his Polish EU driving license (see AG Prenzlau, 22 Cs 279/13).

Polish driving license in Germany : residence principle and other requirements for validity

Compliance with the said 185-day rule is only one of three factors for the legality of a Polish driving license in Germany while at the same time circumventing the MPU. What is also important to know for EU driving license applicants with regard to the residence principle is that you do not actually have to have lived in Poland. All you need is a valid rental agreement, which our agency will be happy to help you with.

The second condition refers to a possible blocking period – a term that we have already briefly touched on in the above section, but which is of essential importance for the legal security of a Polish driving license in Germany. As long as there is a blocking period against you in Germany, you are prohibited from acquiring your new driving license – even if you would travel to Poland to do so. Re-issuing your driving license alone is not enough for your  Polish driving license to be valid in Germany  .
